Tierra Agency LLC — Effective June 2, 2026
These Terms of Service (“Terms”) govern access to and use of the internal software applications and services operated by Tierra Agency LLC (“Tierra,” “we,” “us,” or “our”) to connect with the advertising platforms we work with. This includes, without limitation, applications registered with Meta Platforms, Inc. (“Meta”) for access to Meta’s Marketing API and equivalent applications registered with Google, Axon, and other advertising platforms we may engage with from time to time.
By accessing or using these applications, you agree to these Terms. If you do not agree, do not access or use the applications.
Description of the Service
Tierra operates internal software applications that connect to advertising platforms (including but not limited to Meta, Google Ads, and Axon) to retrieve advertising performance data from ad accounts that Tierra owns or has been granted access to by its clients. These applications are used to:
- Generate internal performance reports for use by our team in operating and improving our advertising agency services
- Generate client-facing performance reports and dashboards
- Monitor campaign health, spend, and pacing
- Reconcile advertising platform data against internal billing and budgeting systems
These applications are not consumer-facing products. They are internal tools operated by Tierra to support our advertising agency services.
Authorized Use
Access to these applications, and to the data they retrieve and process, is limited to:
- Tierra Agency LLC employees and authorized contractors acting in the course of their work for Tierra
- Authorized representatives of Tierra’s clients, where access has been explicitly granted as part of the engagement
- Strategic partners and other third parties engaged by Tierra, where access has been explicitly granted and is subject to appropriate confidentiality and data-protection terms
- System users and automated processes operated by Tierra in accordance with platform requirements
Any use of the applications or their data outside the scope of an active engagement with, or authorization from, Tierra is prohibited.
Account and Credentials
If you are granted access to these applications, you are responsible for:
- Maintaining the confidentiality of any credentials or access tokens you receive
- All activity that occurs under your account or credentials
- Promptly notifying Tierra of any unauthorized access or suspected breach
Tierra reserves the right to suspend or revoke access at any time if these Terms or our security policies are violated.
Data and Content
Data accessed through these applications is the property of the advertising platform from which it originated and, where applicable, the client whose account the data describes. Tierra processes this data on behalf of its clients in accordance with our Privacy Policy and the contractual agreements we have with each client.
You may not export, copy, or otherwise extract data from these applications for any purpose other than the work expressly authorized by Tierra and the relevant client.
Acceptable Use
When using these applications, you may not:
- Attempt to access data or accounts you have not been authorized to access
- Attempt to disrupt, disable, or impair the applications or the underlying infrastructure
- Reverse engineer, decompile, or attempt to extract source code or credentials
- Use the applications to violate the terms of service of any advertising platform or other third-party service
- Use the applications for any unlawful purpose
Compliance with Platform Terms
These applications operate in conjunction with third-party advertising platforms, including Meta, Google Ads, and Axon. Tierra’s use of these platforms is governed by the respective platform terms, including Meta’s Platform Terms and Developer Policies. By using Tierra’s applications, you acknowledge that the upstream platform terms also apply to your use of data sourced from those platforms.
Disclaimer of Warranties
The applications are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Tierra does not warrant that the applications will be uninterrupted, timely, secure, or error-free, nor that the data retrieved from upstream platforms will be complete, accurate, or current.
Limitation of Liability
To the maximum extent permitted by applicable law, Tierra Agency LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising out of or in connection with the use or inability to use these applications.
In no event will Tierra’s aggregate liability arising out of or relating to these Terms or the applications exceed the fees, if any, paid by you to Tierra for the services to which the liability relates in the twelve months preceding the event giving rise to the liability.
Termination
Tierra may suspend or terminate your access to the applications at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to access the applications ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and governing-law clauses) will survive.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Material changes will be communicated to authorized users through the normal Tierra communication channels. Continued use of the applications after a change constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in California.
